Well...
i got broadsided last night in my RX400h, walked away with bruises and a sore back.
They're going to say it's my fault because i "failed to yield his right of way" even though the guy was speeding.

Do a thorough check-up to make sure you're OK .How bad is the damage ?
Make sure you get a check-up within 24 hrs, or any injury that you report after that will not be documented as "accident related."
Also, "Right of Way": the fact is that no one has right-of-way; traffic regulations only state who must yield the right-of-way. Proper use of the "rules of the road" depends on understanding this concept. If the guy was speeding, he was speeding. If he hit your side while speeding, it's different than you hitting his side failing to give the "right of way." What if you were a pedestrian? Does he still have the "right of way"?
