Hit a huge pothole, destroyed tire and rim, how do I get the city to pay for it?

Default Hit a huge pothole, destroyed tire and rim, how do I get the city to pay for it?

Just wondering if anyone ever had similar experience and had any success having the city pay for it. Usually I would let it slide, but today was at least the 5th or the 6th tire I destroyed due to potholes since I started driving (6 years now).

I was on a highway on-ramp, it was completely dark, all the lights were out, and it was slightly raining, so I didnt see the pothole at all, it was jump boom, and there I have a huge bubble in my tire, and I think the rim is bent. I am so pissed off at this god damn city with its officials now, its driving me nuts. How can I get the city to pay for the damages?

Unfortunately, they will only consider compensation if the pothole was previously reported to them. Also, don't hold your breath. It may take months, even years for you to see anything in compensation, if anything.

Cities will pay for it if the pothole was deliberately made by the city through construction or the such. The city cannot be liable for potholes caused by regular use or inclement weather or another car. If the pothole was there as "an act of God" rather than "an act by the city," you can't hold the city responsible.

And it can't be "completely dark" at the ramp; you have your own headlights. You can't use that as prosecuting evidence.

Even if it was their fault, it would take so long for you to get the money you might as well bite the bullet and buy new wheel.

I had the same thing happen to me on my SL55. I took pictures of the tire, the potholes and had someone witness both. It took 7 months for me to get re-imbursed.

My replacement tire and wheel cost $1,530 well worth the wait. As someone else posted , they were previously aware of it since they had painted a red circle around it. The circle showed up beautifully on the pictures.

That's California. And maybe before the budget got as bad as it is now.

No the budget was as bad as it is now when it happened. The financial situation here probably will never get fixed as long as we have the "Bleeding Hearts" in the state legislature.

Wow man sorry to hear. I know all about that living in NYC. I've killed many rims/tires with these lousy roads. I also love the slop job repairs they do when "repaving". Good Luck with your pursuit.

My friend works for a city here in CA and recently some one driving a 360 Modena bent a rim on one of their roads and the city got a good laugh out of it but the guy will not be receving anything in compensation.
