Ferrari refuse to stretch a point


The owner of the world’s fastest limousine — a Ferrari that can travel at speeds of up to 166mph — is facing legal action for infringing the Ferrari trademark.

Dan Cawley, 36, of Cheadle, Manchester, has 14 days to remove all prancing horse badges, Ferrari names and “360 Modena” symbols from the 6m (20ft) car. “What kind of precedent does it set when you can’t do what you like with your own property?” asked Mr Cawley.

Lawyers say that since Mr Cawley cut the 360 Modena in half and inserted a 3m (9.5ft) section of hand-built carbon fibre, the car is no longer a Ferrari.

Under the terms of the lawsuit, Cawley has 14 days to remove the Ferrari badging or he'll have to go toe to toe with the prancing horse's legal department.

So are all those people who build the replicas in trouble too? Gimme a damn break... if he had maybe built something from scratch to resemble the car and THEN put badges on, I could see the gripe (barely).

But since it was a Ferrari to start with and I'm sure it still has the Ferrari running gear I don't see the big deal.

Ferrari doesn't want to be associated with that kind of image. I'm sure there's something in the purchase papers that gives them the right to do this. I know for a fact they monitored your driving of the F50 and took it away from you if you drove it like a grandma or if it sat in a garage for too long.

... I'd say people who build replicas do not have as much money as this guy who can buy a 360, and build a carbon fiber stretch.

it can and normally is since in cases of those "special" ferraris (F40, F50, enzo, 288 GTO) Ferrari makes you sign a contract giving them a certain amount of say in who the car can be sold to. iirc it was put into place after investors bought the F40 en masse lowering the car's exclusivity, which is why only select buyers were allowed to purchase enzos and F50s.

I am thinking there could be some dilution if image with the trademark being done here, or at least that might be the tactic Ferrari is using, but I just can't see this.

He should create a duplicate badge with Ferrari spelled Ferari :D, then they cannot say anything to him because that is technically not their name

true. then i guess if the fine prints say no "aftermarket" parts, which cawley can argue about :D if no aftermarket stuff, boy, some ferrari owners are in trouble, hehe

That is a cool concept from comebody that obviously has more money than a little bit.

I can see the dilution argument on Ferrari's side, but as a matter of PR, a car like this only gets you more exposure and this guy probably can and would have bought other Ferrari's with his kind of money!

That sucks for the guy. I'm all for purchasing a car and modifying however you want. Imagine if Lexus wouldn't allow us to modify our cars. What exactly does the fine print state anyways?

I wonder if Ferrari is equally interested in suing the inbred morons who buy an F50 and smack it into a hillside. That gains more coverage and a far worse image for the marque than someone who chops and stretches his bought-and-paid-for Ferrari.

Damn, I guess if I become ultra rich I'm skipping the Ferrari and buying a Lamborghini. I really dislike when companies do this sort of thing. It is funny how so many people complain about how much the government is in our private business but yet let companies do the same thing.:thumbdn:

props to the limo owner. I say ferrari should take a walk. he bought it, it's his to do what he wants with it. just like lil4x says - what about all the peeps who are crashing their ferraris - what does ferrari do about that? nothing.

so - let the guy have his fun! who cares if he has prancing horse badges.

Yup sounds fine to me. If you don't like it, dont buy a Ferrari. They desire a certain exclusivity and don't want their cars being stuck in garages for 20 years and never driven. Thats another reason for the F50/Enzo monitoring.

Its in the paper that people sign when they buy them. If you don't like it, go buy a Lamborghini or Porsche

Yet the resale value of a used Ferrari drops like a rock the more miles you put on it.

The value of the Enzo's keep going up, don't know anyone yet personally that hasn't lost money on it. There are a few other Ferrari's I know of that are NOT negatively affected by mileage by any remote means. The mass produced ones definitely are affected by mileage however.

And Ferrari is very selective who gets to receive what rare model as they are produced. You pretty much had to have had an F40 to get an F50, and had an F50 at some point to get an Enzo from what I remember offhand. They love fans who have collections.
