She also said San Diego has to assess the vehicle themselves for them to make it right. Also, to add salt on the wound, she said they may or may not cover the diagnostic fees incurred from Lexus of Escondido. I'm pretty damn bummed about this entire experience. Is it too much to ask for an L certified vehicle that Lexus backs to not have bent rims and overspray addressed? I mean c'mon!!!
This makes sense. These repairs need to come out of Lexus of San Diego's pocket since they are the one who sold the car. Used cars are not like new cars, there is profit to Lexus in the certification but very little, its a purchase between you and the dealer and Lexus isn't a party to it.

Go back to L of SD armed with what Escondido found and ask to speak to the General Manager. No sales managers or service managers, the GENERAL manager. I bet they will fix it.

Not necessarily. People bend rims all the time, and the overspray does not mean it was in an accident. I have seen cars that were never painted covered in overspray...

And the ASB actuator should not buzz every time you brake. It happens once in a while, but not every time. Can you describe it again?[/QUOTE]

It's not fraud, it's CPO!

That's why I say to always judge a car based on what it actually is since lease cars get the hell beaten out of them more often than not.

Its a used car...its always a crapshoot and you have to do your due diligence. There isn't really a "material defect" disclosure requirement for used cars like there is for homes.

CPO - take your pick:

Constantly Passed Over
Consistently Producing Odd-noises
Copious Previous Owners
Consistent Problematic Operations

So here's an update on what happened with this purchase. I've been working with case manager from Lexus corporate and she has taken care of everything. She got in touch with Lexus San Diego's service manager and got the ball rolling. I was contacted and took my car in. They advised 3 wheels needed to be replaced. They covered the cost of the bent rims and addressed the overspray. Looks like they were able to buff it out somehow. The service manager did not seem too happy with me since corporate had to get involved, but hey...This should've never happened. How do you certify a car in such bad condition. In the end, I am very pleased with the way Lexus corporate handled the situation.
