While I don't like the idea of property confiscation either, it is NOT legalized theft. No one is forced to go street racing, which is illegal to start with. That is simply the penalty for stupidity and recklessness. One must think about that before doing these things.

Well, as far as contraband goes, street racing is just as illegal as drugs. To use your car for one is as bad as the other.

Apparantly judges agree. I don't know of a single impoundment law that has been overturned on 4th Amendment grounds.

Here, in Washington, DC, you can also have your car impounded for picking up a prostitute.

Impounding is different from destruction. In many cases, people don't own the vehicles they drive. So crushing them punishes someone OTHER than the offender, which is PATENTLY illegal. If cars are impounded and not claimed, they can be returned to the lien holder, or sold if that is what the lender prefers.

This story REEKS of sensationalism. If the people own these cars outright AND they have stolen parts AND they street raced multiple times, I can MAYBE see this passing constitutional muster. Any other situation and the state is just asking to be sued into oblivion.

Wrong. Auto-impoundment laws have survived court tests....the judges have thrown out most of the lawsuits.

Don't get me wrong. I'm not saying I agree with the laws 100%, but these laws, in some places, do exist, and they are a reality we have to deal with.

And what is the best and most obvious way to deal with them?
You got it.......slow down.

I mean its so much easier just going to to a spot where they don't have innocent people. If we kill ourselves then so be it, we know the risk.

Its not all stupidity. I mean the guys that I hang with are muture people. We have our spots through out the metro area where no one is at night and go and have fun. After the storm we went to New Orleans East but now its getting populated so we moved. We keep it so were not racing where innocent people are.

IF the car had stolen parts, IF the guy had been caught alot before, IF they were racing somewhere populated then maybe crush the car but really people, drunk drivers kill more people then street racers so why not crush their *****?

Also, what happens to the stolen parts?

I dont think this is the "Full story" theres probably some truth behind this.
How many times do you get caught until they crush your car?
Is there like a 1st , 2nd and 3rd offense or its just a one time deal, you get caught and your car is a goner?
What if you were speeding, and they pulled you over and you had modified parts and thought you were street racing?
Crushed...?

Hence why i put the part, you can avoid racing . I just can't figure out where they think they have the right to DESTROY you're property, granted none of the parts are illegal. There is probably still more to this story than we have all read, as others have pointed out.

In Cali.....

..they will tax you to death so that those who do not pay taxes, illegals and others, can have health care and education paid by the the duly employed
..they will charge you an arm and a leg to register your car, every year
..they will let you go scot free for murder, IF you are rich enough to afford the right lawyers
..they will charge you excessively for gasoline, housing, etc. than almost anywhere else in the country..
they will elect a die hard Republican for Governor even though the state is almost universally Democratic, BECAUSE the candidate belongs to the California de facto royalty, ie, the Hollywood blue bloods
..they will ignore the FACT that FAR [F A R] more death and injury results from intoxicated drivers on public roads every day than from the irresponsible driving of street racers.
..they realize that if they crushed the cars of those found DUI, they would have to crush cars of Judges, policemen, prominent politicians and GOD FORBID, A LARGE NUMBER OF THE CALIFORNIA HOLLYWOOD COMMUNITY.
..to look good and seem as if they really care for the welfare of the public, they crush the cars of the people who can do the least to fight this RIGHTEOUS mindless act..they should sell these cars to some do gooders who would buy the car/s and then crush them if they want, but the proceeds from such a sale can be used to pay the VERY large number of well meaning welfare system that their beleagured tax payers are shouldering.
Now that would be useful.
