Wreckless Driving...

Default Wreckless Driving...

How do you clearly define it?

For example, if you are speeding, you get a speeding ticket; but how does it become wreckless driving? Or what happens if you pop a wheelie on the freeway, or do a burnout from a stop in a parking lot?

What line has to be crossed for it to become "wreckless"?

i am not sure if there is a fine line for that, but there are some guidelines, maybe a situation where you can endanger other people's life.

btw, speeding is speeding if you are under 100. over 100 i believe that's reckless driving. and for example if you drive very aggressively and cutting lanes, etc... you can be cited for reckless as well

Here you go:

reckless driving n. operation of an automobile in a dangerous manner under the circumstances, including speeding (or going too fast for the conditions, even though within the posted speed limit), driving after drinking (but not drunk), having too many passengers in the car, cutting in and out of traffic, failing to yield to other vehicles, and other negligent acts. It is a misdemeanor crime. A "wet reckless" is a plea in a drunk driving prosecution allowed to lessen the penalty when the blood alcohol level is close to the minimum allowed by law

It is wreckless IF you get caught by cops/cited/and then found guilty by a judge.

To some extent, it becomes a "catchall". Here in PA, only state police are allowed to use radar. Local departments, if they want to catch speeders, have to use a stopwatch and 2 lines on the road. So, if they aren't set up for this kind of speed trap, they can't really write you a "speeding" ticket. But--if they observe you clearly going faster than the speed limit (say 50 in 25), I bet they could get you for reckless driving--they could never prove your speed to support a speeding ticket. They can't write a speeding ticket for "about" 50.

Beyond speeding, your examples are perfect. They are not going to write the traffic code thinking up every possible variation of how you could drive recklessly--they don't need to.

I'd be interested in seeing some type of listing of behaviors that judges threw out as "reckless driving".

absolutely wrong. i was caught 93 in 65 and it's just speeding. like i said, 100 over, you are reckless. maybe that's the case for local, but definitely not in general

True.

100+ is wreckless. In fact, it's now a felony in California.

That means, 100+ equals jail time, loss of driver's license, impounded vehicle, and thousands of dollars in fees...

yup, 100+ is not infractions anymore. it's misdemeanor, which is also felony. they have the right to put you in jail overnight right the way and impound your car. and for sure that's reckless driving too. under 100, the cop can be a real ***, but it's still considered speeding and infractions

Again, I despise how lifted trucks tail-gate and try to go fast. I think that qualifies for unsafe driving.

Every time I see a lifted truck flooooring it with their mega-flow exhaust screming, I just think, "pish tosh, your gas money to lose, you gonna feel the it at the pump."
