Audi Driver Kills Teen, Sues Dead Youth's Family Over Car Damage

Spanish driver sues dead crash cyclist for damage

MADRID -- A Spanish driver who collided with a cyclist is suing the dead youth's family 20,000 euros ($29,300) for the damage the impact of his body did to his luxury car, a Spanish newspaper reported on Friday.

Businessman Tomas Delgado says 17-year-old Enaitz Iriondo caused 14,000 euros ($20,500) of damage to his Audi A8 in the fatal 2004 crash in La Rioja region, the El Pais newspaper reported.

Delgado, who has faced no criminal charges for the incident, wants a further 6,000 euros to cover the cost of hiring another vehicle while his car was being repaired, El Pais said.

The youth had been cycling alone at night without reflective clothing or a helmet, according to a police report cited by El Pais.

His family won 33,000 euros compensation from Delgado's insurance company after the firm acknowledged he had been driving at excessive speed and this could have contributed to the incident, El Pais reported.

"I'm also a victim in all of this, you can't fix the lad's problems, but you can fix mine," Delgado told the newspaper, ahead of a Jan. 30 legal decision on his suit.

The family said they had previously pitied Delgado for the guilt he must feel at killing their son but were now disgusted that his greatest concern appeared to be money.

"This was the final straw, a kick in the teeth," the youth's mother Rosa Trinidad told El Pais.

Wow, that's cold!

It does bring up a point. How many cyclists (or runners) have YOU narrowly missed on a dark street?
The youth had been cycling alone at night without reflective clothing or a helmet, according to a police report cited by El Pais.
The first block or so of my heavily tree-lined street often hosts young cyclists or strollers, fashionably dressed head to toe in black, well after dark - with no reflective patches, not so much as a white handkerchief to indicate their presence - and no sidewalks. Most insist in traveling in groups of 2 or 3 right down the middle of the street, and at speeds over 15-20 mph they are invisible until it is too late. A platoon of speed bumps recently deployed on our street has helped mitigate the problem, but there is still considerable danger for blacked-out pedestrians and cyclists after dark.

A mess. The guy was not found guilty but you would think living knowing you killed someone would be on his brain.

WRONG. Instead, he wants his car fixed!! COOOOLD-BLOOOODED!!! IMO, inappropriate, someone died here, even if Darwin won out.

Yes, I'm amazed by people on bikes or jogging at night with no safety gear/reflective gear. Nuts!!!

Before passing such severe judgment, keep in mind that the article doesn't necessarily tell the full story - did the cyclist swerve or cross into the path of the vehicle? Was the cyclist being otherwise negligent (something beyond not wearing reflective/visible clothing to qualify)? Again, we presumably don't know all the facts, but the bottom line is simple: The cyclist might have been killed but that doesn't mean that his estate shouldn't be liable for damages that are his responsibility.

What an ***, like that picture above

I do agree that some bicyclists wear no reflectors or other detectable clothings to help them from not being hit. Even stupid pedestrians jaywalking at nigh wearing ALL black.
But not driving like a maniac may just injure (badly) the cyclist and not kill them though.

both are in fault really...he hit the kid and the kid didnt wear any reflective clothing. but messed up that hes suing the family though. ive had some near experiences with people walking on the side of the road without reflective clothing under dark lit areas. scary but good thing i see them before something tragic happens.

Delgado probably wants the kid's homeowner's policy to pay for his car repair. The decedent's family settled their insurance claim--the article said so. Y'all takin' it personal. The media does not always give you the full story. They were sellin' outrage and you were buyin'. If they were both to blame, let each pay some of the damages.

damn audi drivers... thinking they are the center of attention. lol. jk.

i'm surprised he didn't see the bicyclist but then again, put a 17 year old kid behind the wheel of an A8 and watching the road is probably the last thing on his mind. he was probably thinking about what mods to put on his car, what his friends think about him, how many girls he hopes to get, what he's gonna do for the weekend... blah blah blah. stupid 17 year old.

If he can afford an A8, he can afford a whole new one.

I don't care if the cyclist was at fault, it is the lowest of the low to sue in this matter.
