Default BMW of Lincoln refuses to honor EBAY auction winner

Apparently, someone bids 60K on a FULLY LOADED M3 sedan knowing that he will get outbid. However, he wins the auction, and the BMW dealership is refusing to sell the car at the winning auction price. Link here: http://www.m3post.com/forums/showthread.php?t=127993

That is poor business against BMW of Lincoln. They will have to break a contract (which will take $$ if the bidder decides to go to court), and it's better to make ONE person happy instead of A LOT of people UNhappy.

If they were smart, they should have had a Reserve Price...

Wow, and noone was willing to bid above 60K? I guess people feel the car is overpriced.

The dealer is at fault. They didn't set a reserve price. Too bad, so sad.

I hope this guy takes BMW of Lincoln to court. And I hope word of this spreads like wildfire on the Internet so that BMW of Lincoln loses business.

Actually, eBay can be weird at times, especially for big-ticket items such as a brand new BMW.

Most people are afraid of the impulse-bidding commitment (both the buyer and the seller) and are worried about financial transactions online (enen though the dealership will most likely provide the financing). Only well-versed eBay buyers know what they're doing, and perhaps the winner of the auction knew exactly what he was doing...

IF the winner takes it to court there shouldnt be much problem forcing the dealership to sell him the car at the set price, thats the fun thing with ebay, winning is a CONTRACT for both buyer AND seller.

And the dealer should just give.

The amount of time and energy to go to court against eBay's policies will be costly.

Like I said, just make the one guy happy. They can even profit by advertising their "excellent value"...
