While I feel for any pedestrian getting hit by a moving vehicle, through observing some of the behaviors in the surrounding tri-state area, I can't say I'd place all liability on drivers.

Many times, pedestrians are inattentive, wear dark clothing at night, boldly walk when they are not supposed to, and in some shows of bravado, take more time than necessary to cross the street, because it somehow proves something when they force drivers to wait. In more cases, they'll have headphones on, not care to look both ways before crossing, or they’ll be using a cell phone or some other device; other times, they'll blindly run out to catch a bus or something, throwing caution to the wind.

Ultimately, they have to take more responsibility, as the potential long term or even fatal damage from a collision, isn’t worth being a victim. There is no way I'd ever try and cross a street, without knowing I'd make it to the other side, first…and a bit of forethought goes a long way when sharing the road. While I don't condone speeding on public roads, I think pedestrians need to wise up when it comes to crossing the street. I've seen too many examples, where right or wrong, a situation could've been avoided if both drivers and pedestrians worked together.

I don't know about that - it looked like the pedestrian couldn't decide which way to run and chose wrong (not that he had much time to make up his mind).

look at the video. the opposite direction had no cars coming.

he should've made a dash for it. there was plenty of time and room
