Toyota's hybrids could be banned from the american market?

if they're so stuck up about patents, why not sue all cars for copying the basic design of the first automobile? or all car manufacturers for production line? do we have to pay a patent for writing in English language since we're copying the first guy that created it? If Toyota say they innovated it from the ground up then sure, but wouldn't that also allow Toyota to sue other manufacturers then?
Why do they only sue Toyota? Why not the whole industry? They being racist?
And most likely none of this is going to affect any Prius's sales since most normal consumer is even going to care about it.

without patents, people are LESS likely to invest in r&d because they can't be sure they can protect their inventions and thus have a better shot at making a return on the investment.
it cuts both ways too... forget the company going after toyota, let's say this wasn't happening but that in your world toyota couldn't have patents for any of their tech, and other companies just go ahead and rip it all off, reverse engineer it, and reap much of the profit from toyotas mountain of investment. kinda would be a bummer, no?
