today, weed smoker musk is at it again on twitter calling sec "shortseller enrichment commission" alone with a bunch of other non sense tweets, it seems that his anus has healed up from the secs' reaming and he's back for more. so if you profited from last weeks dip get ready for more profit taking. $$$

That's just it, though.....Musk apparently isn't going to allow any board changes without a fight. Granted, in the end, the SEC is probably going to have more power than he does...but he's going to have to learn that the hard way.

Very true - that's about the long and short of it.

Re today's tweet specifically, I think he's made another big mistake. The settlement deal is still pending court approval, so the the judge may still choose to reject it or the SEC may just get tired of the antics and withdraw the offer to settle. By many measure Musk/Tesla got off lightly with the settlement. That the latest tweet was even posted speaks to issues that were specifcally part of the settlement (the need for more board oversight) and it really just highlights some lessons still need to be learned while simultaneously poking the bear...

Mr. Musk is flipping the bird to the SEC with this tweet. In that earlier settlement that he agreed to:
  • He would step down as chairman of the board of directors (but remain as CEO).
  • The board would appoint 2 new, independent directors to the board.
  • The board would establish a new committee of independent directors and put in place additional controls and procedures to oversee Musk's communications (keep a cap on Mr. Musk's off-the-cuff tweets).
Could the SEC bring up contempt charges against Mr. Musk?

The SEC is regulatory, but generally has no enforcement powers. If criminal charges are involved, the DOJ would probably have to take care of it. A good example was when Martha Stewart went to prison over that stock-trading case. She was prosecuted by a U.S. Attorney....in fact, Jim Comey, who, at the time, was the U.S. Attorney for the Southern District of New York. He later, of course, went on to head the FBI...and get fired.

So he just openly admitted to trying to screw the shortsellers by saying the SEC is helping the shortsellers.

bought some Tesla stock again. and the cycle continues . Made a quick buck last time buying at 271 and selling it at 313, planning to do the same this time around. Lets not forget, musk aside, Tesla numbers should be good this quarter!

For all the crazy stuff Musk does, we do have to acknowledge that he's involved in some truly cutting-edge stuff - and in that spirit it was super cool to see the Falcon 9 launch tonight. It flew from Vandenberg AFB, so quite a way south of here, but we still had a great view of the launch. So cool to see, and they nailed the landing too.
