Please advice! Got pulled over by cop bc tint over brake light
So my friend's sister was driving home on the in her 06 GS on the 10 fwy when a CHP officer pulled her over and wrote her up a citation.
The CHP officer noted two violations on the citation:
1. illegal tint on front windows
2. tint over the third brake
So she went and got the tint stripped from her front two windows but she went on the DMV website and did not see any laws over tinting over the third brake light. So I wanted to see if you guys can advise her on this situation and how she might go about resolving or getting the ticket dismissed.
is there actually a law that states you can't have tint over your third brake light??

On your fixin ticket or citation ticket, you should see not only violation notes but the CHP violation codes as well. Do you see it ??? IF there's no violation law code stated, then Traffic Judges normally drop your case and pay $10.
There's a code for Front driver side tint violation code, but NEVER heard of rear window nor third brake light tint violation code.

The high mount is considered a safety device so the reduced visibility caused by the tint falls under a couple equipment violations. There is a section and sub-section regarding obscuring lighting devices and this also covers blacked out tails, headlight covers, non-approved lighting devices, colors...blah-blah.
The easiest is to simply cut a window for the high mount brake light.
How dark was the tint?
The DMV sells the CA VC books for about $6.50. Just walk on in and ask for a copy. I'd suggest that anyone modding their car pick one up so you can be familiar with the various equipment laws. Glad this came up, I need to get one. These come out each year and is like the ever changing tax laws. It is pretty thick. March to May has the new books for the coming year so if you buy one now, it may be a 2004 revision and not reflect all the current updates.

Like RA40 said, I'm pretty sure this falls under the code section defining obstructing a safety device or something like that. What were the actual violation sections on the ticket?
Then again, I've never heard of a tint shop lazy/cheap enough to not cut around that rear brake light.
