Default Speeding Ticket Help

Basic Speed Law

22350. No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
Ok, my wife got a ticket the other day for doing 50 in a 35 on a surface street (not a highway), issued by a local PD, not the CHP. The violation is 22350, Basic Speed Law. This is our first ticket in California.... any ideas?

Some observations on the ticket:

1. Address is incorrect. I don't know what the guy was doing when he copied the addy off my her license, but it the street address is clearly not where we live. Can she get off on a technicality here?

2. Under comments on Weather, Road and Traffic Conditions, it looks like he wrote "C-D-H". I'm assuming the C=Clear weather, D=Dry road condigions, I don't know what the "H" means. I would assume "H=Heavy traffic" but my wife says that she was practically the only one on the road.

both 1 and 2 won't stand a chance. did the cop use radar or not? if so, then it's a strong case against you

Yeah, important if he used radar or not. What city was it in?

The ticket indicates that radar was NOT used. My wife said he was following her for a while (like a mile or so).... happened in Azusa.

you could try calling the court clerk (back of the ticket for tele#)
find out how much the fine is
if you plead guilty, traffic school should be an option
pay the fine... go to traffic school
send in the necessary paperwork
chk DMV records later to make sure it's not on her record (no pts - insurance shouldn't go up)

Sounds like he paced her. You can file a request for discovery. Ask when his speedometer was last calibrated. or, check out www.ticketassassin.com

Easier to just go to traffic school tho.

if he paced your wife, that's a completely valid method here in cali as well, still don't have a case, especially if it's over one mile (50mph for 1 mile is a lot). people talk about checking out the calibration on the speedo and such, imho chances are small that those stuff went wrong, and you just give the cops an indication that you are going to fight it

maybe just go to court, admit guilty, and go to traffic shcool. a lot of times they reduce fine if you go there and plead guilty. 50 in 35, that's 15mph over, and i think the ticket is about 150 to 180 bucks?

Yeah my g/f got one several months ago for doing 52 in a 35. the fine was $165 + 20 for traffic school. Just pay the fine and have her go to traffic school. Some cities will allow you to do traffic school online.

doesn't matter if the add. is wrong. you got the ticket. it's your responsibility to correct. if you don't they will come and knock on your door.

tell her to do traffic school. some city you can do online traffic school. one thing you have to watch out is that you have to keep your proof that the online traffic school sent you. my girl took her online traffic school and i guess they might forgot the send the certificate to the dmv, which she still got a point on her record. now she has to dig up all her stuff to find that proof.

your ticket should at least 2, close to 3 with traffic school.

Definately just do traffic school...Sounds like your SOL on this one...

I believe i paid 225 for a 64 in a 40...

Traffic school is your best bet. Didn't your wife notice the cop following her for a whole mile?

Yup, like what everybody else said. Just do the traffic school.

I was pulled over going about 80 on the 210 near glendora.
Was nice to the CHP so i didnt get a no front plate or TINT on my ticket.

Paid about $160 for the fine and Did traffic school.

it's her first ticket, pay and go to traffic skool. Don't they have "internet" school now ?? Or go to one of those Chinese own school so they can let you out in an hour !!!

damn i love those chinese school in LA then

here in santa clara norcal (every county is different), it's so stupid that if you do the online traffic school, you have to go to one of the proctor exam.... wtf.... personally i hate exams so i'd rather go to the traffic school and spent my 8 hours there
