i've had that happen to me at a gated community--the homeowner's association has a rule allowing visitors to park in their community for 48 hours without penalty or tow, but my car got towed in 3 hours while i watched the super bowl game.

what was really messed up was....the homeowner's association president called it in. -. -

another time...my dad had his van towed from a gated community as well, and not even a towing company nearby, one over 20 miles away--gotta kickback that long distance tow fee ya know?

So parking enforcement tows the car, acts like they don't know what happened. Car surfaces back up again. And now wanna charge big bucks to get it back? WTF?

I would take them to court, easy win. $$$ for wheels + more lol

HERE IS THE UPDATE:

I pay 5500$ for 10 spaces in this parking lot per month. 4 spaces are permanent (as in they are designated for 4 of us), and the other 6 are open spaces, that we have for visitors and what not. Out of the 4 spaces, the Bentley and the Porsche is there all the time. The other two spaces, me and Caroline always have different cars and what not, but those spaces are ours.

Last couple of months I have been taking the Turbo Miata and the Cooper S, and that is what was parked in my spot. The new parking lot attendant didn't recognize my new SC, and called the towing company and had the car towed, within 3 hours of parking there. They are well aware that we rent all 10 of those spaces, but did this anyway.

The San Diego PD identified the car at a local yard. Had they not found the car, I believe the parking lot/tow company would have kept it for 30 days and tried charging me for that amount. The PD will also be prosecuting the owner, and I am in the process of bringing a civil suit as well.

Most of the evidence leads us to believe, that this was a scam, and is common in San Diego as already pointed out in this thread. The car is unharmed and immaculate as it was. They want to charge me storage fees and towing fees, even though it was their mistake. Policy states, they are supposed to check with me, if ANYTHING happens in those 10 spaces. They failed to do this.

I am pursuing legal action through them. They messed with the wrong person. I didn't spend LP640 $ on my brain, to be dicked around with lowly parking attendants and moblike parking lot owners.

Will keep you updated.

Thats really good to hear that your car is untouched. Great that you are prosecuting them. Maybe it will stop future people from doing this thing.

Good to hear you got your car back bro. Here's an article in the UT about 2 towing truck firms pulling this illegal kickback stuff similar to yours. http://www.signonsandiego.com/news/m...n07towing.html

Hopefully you take them down and then some.

Glad to hear the SC was recovered. You had me scared for a moment thinking people were jacking SC's in San Diego.

Glad your ride is okay.

NAIL THE SCUM!

This is the reason why I have a distrust of private lots...too many of these scams.

I have no choice but to use the private lots during the day.

The price is worth it, given location and demand out here. I used to pay a LOT more for 6 spaces in SF.
