Sincere thanks to everyone who replied.

We were under the (apparently inaccurate) impression that if the dealer said the problem had been fixed, then it had indeed been fixed. Or that Lexus warranty would "make it right".

We are seeing indications of increased inventory of new 350's and will probably pursue that option.

With any risk involved, buying new puts you in a much better position should you get one with a hosed up transmission than having bought used. Keep us posted and hope you stay active here.

Ditto ES350BOB. Once you buy the buyback (and it might be notated on your registration), you will be really at their mercy.

I saw a Lexus of Bellevue\Seattle commercial the other night where they said they had 100+ inventory of the ES350 "that must be sold". Special event or something. You can probably get a good deal on a new one right now. A new car is currently your only hope of ever getting a buyback if\when you hit trans problems. Good luck.

I would guess the 08s should be on the floor in another 6 months or less.

That (may) be the best option yet.
