I’ve also bought two different vehicles from Hertz and Enterprise. Both former rentals and the one I drove for two years never gave me a problem. My mother-in-law is now driving the other one - a 2018 Hyundai Santa Fe Sport that I bought from Hertz - and loves it.

A dealer’s service department can run a VIN and give you a service report.
I bought 2 "salesman's" cars. Test drive, loaners who knows. Both had under 6000 miles. 1980 Malibu Classic - I only had 2 issues with over 100,000 miles. 2001 Solara - Other than what sounded like a belt squeal from day 1. I had no issues at all. So yes, sometimes you can get a nice one.

Hey guys, I found a 2023 Lexus ES 350 with 13k miles for $37,648 plus taxes and fees for around 40,600 with Taxes and Fees. Do you think its a good deal? No matter how much i tried dealer wont budge on price.

Here is everything it has Original MSRP around 51k

Lexus Interface With 12.3-in Multimedia Touchscreen Display. Includes 3-year Trial Of Drive Connect With Cloud Navigation, Intelligent Assistant And Destination Assist** Smartaccess Card Key** Power Open/Close Trunk With Kick Sensor** Wood Trim With Ambient Lighting** Premium Package: Lexus Memory System For Driver's Seat, Outside Mirrors And Steering Wheel, Power Tilt And Telescopic Steering Wheel, Power Folding Outside Mirrors, Rain Sensing Wipers, And Heated And Ventilated Front Seats** Wireless Charger** Rear Spoiler** Heated Wood & Leather Trimmed Steering Wheel With Windshield Wiper Deicer & Fast Response Int Heater** Wood Trim** Apple CarPlay** Leather Interior** Heated Seats** Sunroof** Satellite Radio** LED Headlights** Dynamic Radar Cruise Control, Lane Tracing Assist, Lane Departure Alert w/ Steering Assist, Intelligent High Beam Headlamps & Road Sign Assist** Blind Spot Monitor w/Rear Cross Traffic Alert and Intuitive Parking Assist w/Auto Braking** 18-In Split 10-Spoke Alloy Wheels** 1-Owner with a Clean History and No Accidents that was Serviced Regularly and is in Like New Condition** Dual Exhaust** Back Up Camera** Leather Interior** 3.5 Liter V6 With 302 Horse Power** Up to 32 MPG**

Dealer also selling CPO for 3k i got it down to 2k if i want it. Not sure if VSA is better option.
Any opinions?

What you have there is a base trim highly optioned. I just bought a 2024 same options sticker $50,250 bought for $47,000, plus, plus. The trade in values have dropped 20% or more from December 1st. Depending on when the dealer bought the trade, he may have little margin left (their still making money). The seats in the base trim are "leather like". I find they absorb smells more than the real leather.
CPO? The records sound in good shape. Don't know if I would pay the extra. You buy a Toyota or Lexus for great reliability.
Do a little research on the retail value of the car. Do a Google search for 2023 ES350 for sale in your area. You'll get listing from Kelly BB, Carmax etc. Maybe you can use that to sway them to lower the price.

So you got your 2024 for 47k OTD? Or that does not include taxes and fees?

In my area I was able to find 2023s usually around 39k and only 2022s for that price. Compared to others dealer was already selling 2k under. Carmax gave the car 35k trade in value. So I know they making money, but still wouldn't budge. I wonder if I should just hold off on purchase until later in year?

If I buy a 2024, I’ll wait until after the new model 2025 comes out and is available on the lot. Hopefully, the 2024’s will sell for less. I also want to make sure I can do without the 2025. Who knows, it could be really beautiful.

That's Plus, Plus - Tax, Fees. My dealers DOC fee was only $50.

I think I found your car on Edmunds. Same year, trim, mileage and price. They said fair price about $400 under average. Other 2023 with less than 6000 miles are going from $40K to 43K. So that prince is pretty good.

DOC fee in my opinion is gigantic joke against us. My family sold our dealership after 70 years in 1980 and before that we started charging $9 DOC fee to help with backend and ended up taking it off most of the time because of customer complaints. Dealer here charges $799 and won't budge. That fee is no longer aimed towards backend costs but just profit. Wanted to charge me that again when I bought out my lease and I found a Lexus dealer 2 hours away that did not charge on buyouts so I did it there as there philosophy was I already paid it once on same car. In NC buyouts have to come from a Lexus or Toyota dealer. Ridiculous.

I agree with everything you said but from my perspective as a buyer, I don’t care how the dealer labels and breaks out the cost components. I’m only concerned with my OTD bottom line cost. He can call it lunch fee for all I care and make it three times as much. It’s only the bottom line that matters to me at the end of the day (deal).

If the is a limit on their DOC (electronic documentation) fee, you will find it on your state's .org website. Ex. search - NYS Doc Fee. NY has a max limit of $175. Some states have no law so they can charge what they want.
I see you live in CT. I was there 13 years. Do they still property tax your car?
