While I don't like the idea of a company using someone's photo and creating an ad with it, you can't sue over it unless you registered the photo for copyright.

As for the Craigslist ad, since it doesn't appear to be a commercial entity selling the wheels, he's trying to give someone an idea of how they would look on a car that they fit. I don't see anything wrong with that, as they're clearly not a "common" wheel that someone could just bring up on Tirerack (or similar) website and see how they look.
