Same **** happened to me, i didnt do nothing wrong and some dumbass tried over pass me from left, the bastard sped up as i was switching lanes and he scraped my left side. Cop came and told me i was making an unsafe lane switch, which i didnt ... So in a prosses to try and sue the idiot i got my licence taken away for a month.. Some much for justice ...

That sucks big time, thankfully no one was hurt. But from your description, I would say the best you can hope for is 50/50 (if that is an outcome in your area). If this happened here in BC, this is how our monopolized insurance would see it:
1. You were crossing lanes and collided with a car that was completely in the other lane. This is 100% your fault.
2. The other car may have been traveling at an unsafe speed (but without a police report or witnesses to back it up, I doubt it would stick.) They would only pursue this if they thought they could get away with screwing his insurance coverage too.
I would talk with a lawyer - particular in regards to how the police handled your side of the story (e.g. not at all.) Maybe the lawyer can find a reason to discard the police report because of apparent favouritism, no statement from your side, and of course relation to one of the accident victims.
That sucks too - but from your description, the other driver was a jerk road rager type, but you still caused the accident by entering his lane. Unfortunately road rage and entrapment doesn't make it their fault.
Just my .02 - having had to deal with our crappy insurance monopoly on 5-6 separate occasions now, and being a very objective person (even towards myself), I can pretty much tell how they will determine resolution right away.
