IMO they did nothing wrong and I did my research to find out there was nothing they could have done different to stop it from happening.

I guess I see this differently having gone through it. I do think this can be fixed for much less then 5k.
that's why i asked too. i really don't see why this would cost 5k to repair?

5k is to straighten the fender since it was pulled out and to fix the lip. Then the repaint for pretty much the whole back of the car including removin all the tri
and replacing it with new trim. 5k was the insurances companies quote. My buddy said he could do it for less. What that number is i don't know yet

$5k is a bit much. Might as well get new fenders for the front and cut the lips off while they are off the car. Rears, I guess it will have to get fixed but I don't see $5k of damages unless it's super wavey. Didn't you say the quote was from an expensive body shop earlier? If I was a shop owner and was approched with an estimate like this, I would turn it down as well. If you sue them then more then likely (if they were smart) insurance will take care of it (if they have.)

5k may be a little high but like I've said I know this body shop is on point on what they do and they do it right.

If the lawyer says I have a case I want to talk to the shop owner because I honestly don't want to screw him. I want to see what his insurance deductible is. I'd be willing to help him if he can help me.
