Default Sad Day for me

Was driving to my friends BBQ yesterday and was in a one car lane. Long story short, saw something in the road and weaved the right a little bit. As I was coming back into the lane, this jerk tries to pass me up, crosses the double yellow line and my car slams into his.

A week before that, i got a DUI right at the legal limit. I'm so depressed right now.

Did the cops ticket you or the other driver as at fault in the accident?

A few words of advice since I've had a couple of friends in your situation before:
1) if the DUI really was just at the limit, if there was a large time delay between the test and when they stopped you, a lawyer might argue you weren't at the limit when you were actually driving. Difficult argument though - most likely you get standard first time penalty which is going to cost you about $10-15k over the next three years between fines, lawyers, and high insurance charges. But you won't lose the ability to drive.

2) Go hang out with some friends. Watch a movie or go for burgers or something. You can't dwell on this too much because it will get you depressed.

Also suffice to say, you shouldn't drink anything and drive. Even one drink impairs your judgement, and without judgement how can you tell if you are at or below the limit.

The cop did take a statement but apparently they're not allowed to side with one party. They can only make a actual report that something did happen. It's all up to the insurance companies to deal with.

Thanks for the advice Batman. I'm definitely just trying to keep my head up right now. But I've definitely learned my lesson already. Ive been laying off drinking anything for this whole holiday weekend and won't be having an ounce in me if i'm DD.

Get a good lawyer, if it was a .08 then the charges can be dropped to a wet and reckless instead of a dui.

the good news is that the damage will buff right out.

no seriously, you just need a new door and fender. looks like an easier fix than most.

that really sux, thats the problem with some people on the road, when they give em a drivers license it seems like all common sense goes out the window,plus common courtesy its like everybody is in a rush to get no where

U should have been drinking this day too, your reflexes would have been impaired you wouldn't t have swerved and the ******* wouldn't t have passed u and crashed into u!!j/k sorry for your streak of bad luck!
