I have an appt. to take my car into a different dealer today. When I called them, I let them know the situation and they said they would be very happy to look at the issue with me and see if there is anything they can do to work with me.
Funny thing is, out of nowhere, I recieved a call from my current dealer's public relations manager wanting to know how my last visit was with them on my car. I told her everything and she said she wanted to look further into this issue and see what else maybe could be done. I'm honestly not holding my breath on this one so I am still going to get the second opinion today and depending on the outcome of that, my last resort is arbitration.
Will keep you all updated and thanks for the comments.

So I just got back from getting a second opinion and they definately seemed to spend more time looking at the problem with me and had a better sense of urgency. Not sure if it was because they want to win me over from the other dealer or thats how they always are, but this was a good experience for a change.
Right when I got there, the service manager came out and greeted me and started looking at the issue with me. He also owned a 3GS so we went and compared the seats with his and he acknowleged there was something not right about my seat. He did mention that if the problem was leather then the Lexus rep would have to be involved, but he would want to have me there with the car to talk to her, which I thought was great. Then he started asking me to walk him through my experience with the other dealer about this issue and after I explained, he asked me to wait for a minute. He left and about 5 minutes later, he brought out his shop foreman to take a look at my seat to see if he had any ideas. This guy spent at least 15 minutes looking very thoroughly at every aspect of my seat and comparing it to my passenger seat (which has no issue). He even lifted the seats and looked/felt underneath the seat.
After looking at it, he said he didn't think it was the leather at all and was thinking that the springs were loosing tensioning. He then said he thinks the bottom seat frame needs replaced and just to be sure put a new pad in again. They took my information down and said they were going to check with parts and would call me back when they investigate some more.

Whatever the reason for this other dealer providing you a better experience, it looks like it could result in you getting this issue resolved without much hassle or grief to your wallet.
Maybe you will give them the business from now on as a thank you - thus far it sounds like they're deserving of it.

I just got back from the other dealership and talking to the Service manager and Lexus rep. With no hesitation, the Lexus rep agreed that my seats were in great condition and there was no visible sign of wear/tear. He asked me about my experience at the other dealer so I went through it explaining that they thought the next step was to replace the leather, but when I took my car in for a second opinion, they seemed to think it was a problem with the seat frame instead although they said there could be some stretching to the leather. After that, he said that they need to tear my seat down and figure out what the problem is and they will replace whatever needs to be to make it right, even if it ends up being the leather.
So I am now in a loaner and should get a call letting me know what they find later today.

If you are not happy with Lexus I would stop by a few upholstery shops and see what they would charge to fix it. Some might have seen this already and explain the cause of the issue.
If Lexus even replaces the seat it will probably do it again without some kind of modification.
