Over Mileage lease return?

Over Mileage lease return?
So I recently lost my job and my brother is willing to take on my lease for a few months while I get back on my feet. Biggest concern is I was about 6,000 miles more on my lease so I purchased a E39 540, which is a great, fun car! I might just keep the E39 during the winter and have my brother take my lease till March/April. I was planning on returning the Lexus and getting something new for my fiance maybe next summer. I know I will be a good solid 10K over the limit if I return it early at 2017, instead of 2018.
So,
My question is, have any of your experience this situation where you DIDN'T need to pay over mileage for a new lease/purchase of a new Lexus or another brand? Might be leaning towards Acura MDX or Lexus RX350

Wear and tear are subjective and in many cases are forgiven when you commit to another lease.
Termination Fees are officially waived when you stay with the program.
Mileage is strictly adhered to, it is what is documented and CarFaxed and reported to the state...
What may work is to look into an early turn in. When the manufacturers want to support new
sales they trot out a "3 months forgiven" type offer. You may still be over the miles but will
not be adding any more, at $.25 / mile it piles up as you already know.
Separate approach is to see if the dealer will just take it on trade. Conventional retail type
appraisal with the residual & balance of payments used as "pay off". If it books out favorably
you trade it to them instead of turning it in to Lexus Financial.
