Send a reply to that SCUMBAG quoting their own web-site asking if he cares to restate his position before you report them to the FTC.

I believe the CPO process is allready done when the car hits the lot for sale. I'd be calling the gen mgr and lexus to let them know what's going on.

I wouldn't be a bit surprised if the GM knows all about it.
It's his / her dealership and his / her employees.

It is inconventient for you to have to drive down to the dealership to get yanked around like that. But, if that is really their policy (you have confirmed it with that yokel's boss), then simply state that your policy is to not buy cars from dealerships that lie in their published ads, and leave!

That is bullcrap and a way for them to basically try to sell the extended warranty.

1. Car is bought at Auction or is a trade in etc.
2. Car has to have UNDER 70k miles and not been in a severe accident.
3. Car is inspected and if passes it is certified.

Certified does raise the price of the vehicle. Not all are certified, it is a selling tool. For instance many low mileage vehicles with the remainder of the factory warranty won't be certified.

Either the car is certified or not. Another thing is a dealer might not want to certify the vehicle as they make more money of higher financing rates for used vehicles. Lexus certified vehicles get special rates, for instance it is 1.9 for 24 months and 4.9 for 60 right now, good as new.

It's probably "encouraged" as another salesman named Tom in a posting on DealerRater.com tried to use the same tactic.

When I bought mine it was Certified Pre Owned, but I was trying to get the price as low as I could. I don't remember the numbers but by having the drop the CPO (no 3 year warranty) I saved. The car still has the original warranty and the CPO would just add a year when said and done, so to me it wasn't worth the extra the dealer had to tack on to the price for the CPO.

Let's look at the positive here - you found out this dealer is not ethical BEFORE you made your purchase. Now you can go elsewhere and get better treatment and a better deal. You've actually saved yourself money and headaches.
