Default Vibration Lemon Lawsuit

I just recieved my ruling on the lemon lawsuit that i brought agianst Lexus for the vibration, and they ruled against me. According to Lexus they admitted that my GX470 has the vibration but ALL the GX470 have the vibration to some degree, some more than others. So since all the trucks have this problem the abritrator felt that it doesn't impair the value of the truck and it is not a safety issue. If anybody else has a lemon lawsuit I would like to hear how yours went. I guess im stuck with mine. Glad I spent $50,000 for a vibration.

Lexus wouldn't settle out of court with you? So since you brought them to court how does that affect your relationship with them? Will they still work on your truck?

No they wouldn't settle. As far as Lexus is concerned there is no problem with the GX470. They all have the vibration and that is just the way the truck is made. The suit just cost the filing fee which was $450.

I thought most lawyers wouldn't charge you anything if you lost the case?

Did you have actual Lemon Law Attorney or just arbutration with a generic attorney?

I know in both of my lemon law cases with GM and Dodge (which I won both) the attorneys wouldn't even have taken my case if there was not at least a 90% chance of the case being won, since if they take the case and lose, they get nothing.

Of course I bypassed arbutration all together with both cases and just filed a lawsuit with seasoned Lemon Law Specialist attorneys.

I have had the similar issues with my car: Steering Vibration and Driveshaft Clunk. Although 'fixes' have been applied to both of the issues, the severity of the problem has lessened but never been eliminated. After numerous discussions with Lexus corporate and the dealer, I am trading in the my current GX (build 9700b) for a new one. After reading some of the posts on here, I concluded that most of the problems people have been experiencing were on the earlier builds of the car. I am keeping my fingers crossed that I don't experience the same problem with the newer build.

I considered the lemon law but figured a trade-in alternative was less of a hassle. The out of pocket cost to me is approx $3000 -- so, basically, $300/month to drive the car for 10 months @ 10,000 miles. I dealt with the GM of the dealership and felt that they were very cooperative.

Rainmn60:

I have started discussions with my dealer about the same resolution -- are they just trading even -up or is this going to cost you?

I have a leased 2003 with every possible problem and would like them to just substitute collateral on my lease -- any tips on what they are willing to do would be appreciated.

Regards.

Hi,

I got my new GX on Friday. I did dangle a carrott, so to speak, and upgraded the car to include NAV which I didn't have on the prior car. My car was financed and they took the car on trade and offered me approc $2500 less that what I originally paid for it. I didn't think that was bad considering I put over 10k miles on it. The deal they made with me on the new car was very good, as well. The dealer was VERY cooperative and, I think, went the extra mile to make me a happy customer. I found that working through the Lexus 800 support was useless since they always acted as a coordinate point between the dealer and corporate. The decisions rested mostly with the dealer since they have the authority to perform corrective actions.

I'm not sure if this is answering your quesitons ... I hope it helps.

I'm a new owner and new to this issue. Still, I do note a slight vibration through the steering wheel while under acceleration at certain speeds. Is this the issue?

Thanks,

Bill

Vibration at 1,600 RPMs and up through the accelerator and steering is one of the issues. Thump (as if you were rear ended is another.
