Also, an attorney may not be able to do much to help you either. The lean isn't going to be considered a substantial defect and probably won't fall under most lemon laws. There's no impairment of use, value, or safety. Other litigation is probably not worth it cost-benefit wise.

After a little research I found a fix, well at it least it worked for me.
I have a 2011 Premium with air suspension and I'm not sure if this will work with out the air suspension.
It involves adjusting the height sensor bracket. The sensor live in front of the rear axle right next to the airbags and bolts into the frame.
You'll need:
This is what it looks like when you under the truck. No need the jack up the truck I just crawled under there and took off the bracket and added the washers.
I added the washer between the frame and the height sensor bracket
It took maybe 5 minutes to finish.
I started the truck but I still saw a lean to the right (passenger side from the back) , but I was to lazy to remove the washers.
The next day after I drove to work and parked and walked around to the back of the truck and to my surprise the back of the truck was level
I've been checking it out everyday since and everything looks great. It was leaning by an 1 inch or so to the right in the back before the I added the washers.

You'll need:
- 2 10mm washers (I took me longer to find the washers than to put them in)
- 10 mm socket and ratchet
- Only add the washers to side that leans

My bad, you are correct. Based on experience, the most problems we've seen are on 14's, most of the others had issues with leaking kdss units.

Read through the other thread. Just wondering if there are any updates on this. I just got a 2017 GX 460 and noticed my lean towards the passenger side. Taking it to the dealer tomorrow and interested as to what they will say based on the responses so far. I have about 80 miles on it and it is a premium without air suspension.

Wow that is interesting...because apparently mine still has the lean. Although not as bad as what i've seen on some of the older models (11,14). I just figured i'd see what they would say about it. Did you call customer care?

No, I did NOT because it is NOT always leaned to one side, just some days it is and some days it is not. I need to be good at keeping tracks of when it is leaned - mainly about the amount of gas left in the tank.

Well after doing some reading across different forums (Prado, 4-runner, IH8MUD) looks like lean could be due to KDSS and springs. Apparently you can try re-balancing KDSS but it only fixes the problem temporarily, leans after a couple weeks again. It looks like putting a spacer in the spring is more of a long term fix. I'll bring this info to the dealership so they don't come back at me with "within factory specs".
