The 9LC program - replacing the existing steering gear on certain 2006 400H models and other hybrids. I had this done on my 2006 RX-400H and it made a world of difference in the steering. At slow speeds, the car would tug left or right, having too much play and seemed loose on the road as well. This program really resolved those issues. This program just came out around 1/16/2009 or so.

my 2006 400h has the exact same problem, is it a recall or do I need to pay for the upgrade? (I am out of warranty)

It is a recall. Go to Lexus.com/owners
Sign up if you havent and i forget where to find it but it should show you if your car falls under the recall.

Just did it. Great service (from my dealer). Full tank of gas, car wash, all under 4 hours. All free. The car drives way better now. I always thought the "wiggle" it did under acceleration was a standard torque steer issue, but that is gone now. Much more solid.

parts + labor = 1371.98, FREE!!

Wow, did we buy a vehicle from an auto manufacture who wants to keep their customers??
