Are you measuring it cold, and are you completely wiping it clean before inserting it for a read? Sometimes there is enough oil in the dipstick tube to 'smear' the reading a bit.

Assuming you are on level ground. Temp not really and issue.
What irks me is the dealer is supposed to prep all new cars before delivery to the customer. Including fluid levels .. yea right.

Bad news, if the oil is way overfull the crank shaft will whip the oil into nice foam. If that happens, bad bad.. Good news, most likely you would of heard noise of that happening.

Document exactly what you have found and have the dealer sign something that confirms the oil overfill incase you run into a problem later. Have the dealer show you (I would be there and witness it.. Don’t trust them.) how much over filled the oil is by draining some out into a measuring container. If it is less than a quart or quart and a ½, you have a good chance that nothing has happened IMO. Anything more than that, I would be concerned.

This is one of many reasons is why I’m now doing my own maintenance.

Oh yea, the dealer may tell you that the dip stick is not that accurate.. Not sure I would buy into that one either. Keep us posted on what you find.

Yes, engine is cold and i wiped the stick before this measurement.

Was it parked overnight?

Usually I would not worry too much if the level is a bit higher than max when measurement was taken with the car parked overnight. IMO the most accurate measurement should be taken when the car is parked for 10-15 mins when there's still oil trapped within the system.

IIRC, the owner's manual of a Honda I have actually list out like 1qt more oil if the system is completely drained (ie. overnight). I can easily see how that 1 extra quart would put the mark above max.
