It is legal if enough light (can it be measured?) is transmitted through.
It is DEFINATELY ILLEGAL if you cannot see the lights working (completely blacked out instead of "tinted", or if you have burnt-out lights, or just removed them altogether).

OK, I’m an old fuddy-duddy, but I don’t understand any of this.
If it’s illegal in some States, there must be a reason; most likely because not enough light is transmitted, especially during bright, daylight hours for the person behind you to see your brake lights going on. That means you risk a higher probability of someone rear ending you.
Now you have car damage. And as soon as your insurance company sees those darkened tail lights (or what’s left of them) they’ll say you’re at fault for adding an illegal mod and deny your claim. So will the other driver’s insurance. So where are you? Cool looking tail lights and a possible $5,000 repair bill.
Has anyone here thought of this?

What about the hapless driver that rear ends him? What about his/her car? Why does she have to deal with front end damage? What if there are injuries? What if someone is killed? Without insurance in this instance, he could be sued for millions. What if the DA considers this a criminal act? Off he goes to jail for ten years for manslaughter.

I believe the "illegal" part of these modifications is blacking out your rear reflectors. Every car has a different amount of light coming from their brake lights. a Light to medium tint on the IS brakelights, even mid-day is still probably brighter then say a car that is totally unmodified from possibly a few years ago.
When Hella sells their smoked tailight kits for jettas and such, they supply you with a bright red reflector you must stick on your bumper or elsewhere. That is so you fully comply with all DOT regulations.

it was about 120, cathafer post a pic of ur car please i really want to see.
In terms of the light output of the taillights, the light output is fine. I checked it during the day and at night. When u brake and when u dont. It looks fine. Safety is important to me, i wouldnt keep it if it was a problem.
