so i was bored and made some drawings

yellow = girl
red = me
blue = other cars
silver = medians
red and green = street lights


in this picture, the light had just turned green. i had been slowing down for the red light so i was going maybe 10-15mph.

in this picture, i started to accelerate. the other cars had just started going, so i was bound to pass them.

the speed limit is 40mph so im starting to get up to about 20mph. i have absolutely no sight of her. its nearly impossible to see her for me.

in this pic, im going maybe 30mph when i finally see her coming at me. i slam on my brakes and plow into her like in the following picture.

she's lucky i wasnt going 40 mph and that i was able to slam on the brakes. freaking idiot.

Now her insurance wants to take 75% of the liability and the other 25% to my insurance. Not once did I contact my insurance company about this. Are they allowed to contact them? There was absolutely no way for me to avoid her other than me not even going out in the first place. The car is going to be fixed back to the way it was, I have nothing to gain from this. The car was in mint condition before so there is no reason for me to have hit her on purpose. This guy is a jackass and I'm gonna give him a piece of my mind. His 75% liability BS is pretty much based on an opinion because he wasn't there to witness it so I don't see how that can hold any ground at all.

I do not plan on going through my insurance unless it is absolutely necessary and if I do, I am sure they will go after them for 100% of the damages, so I see no point in this. Insurance companies suck.

So the neighboring cars didn't stop to offer as witnesses?

Yes, I got one witness. She is listed on the Exchange of Information Report that the cop printed out. No phone # but I do have an address, so if necessary, I can reach her that way. I'm gonna find out what will happen if I involve my insurance tomorrow.

The police report will be the key to determining fault, not the adjuster's assessment of the situation. You need to get a copy of the police report and your insurance involved ASAP so they can get an adjuster to call this idiot and get the proper assignment of fault.

Yea, police report will be ready tomorrow and i plan on picking it up. I think I'm just gonna let me insurance handle it all.

in the state of md, going thru your insurance company also gives you liability protection. maybe something to think about. sorry if this does not help your cause.

man srry to see this happen to yo baby at least no major dmg....but with the insurance goes if they dont take 100% thats just wrong with the diagram that you showed man that is some stupid chick...But if they dont take 100% get a lawyer and you might get some pocket money also :P

You should have called your insurance company day one. They can get you fixed right away and then go after her insurance if need be.

Glad no one got hurt, but beware of whiplash and lingering issues that crop up later on in time.

I'm with everyone on this, get your insurance involved ASAP. You have nothing to hide, you had the right of way and she ran a red light if I'm not mistaken from your drawings.
