If you are going to the dealer and they are installing a brand new OEM bumper then I wouldn't worry about the insurance company backing you up. It's an OEM bumper. I would be more worried about the guy coughing up the cash to pay for a whole OEM bumper then getting it fixed at a body shop.
If you are going to a body shop make sure you specify that you want OEM replacement bumper. Not sure if your quote will be cheaper then the dealer on that one, but make sure they have some sort of guarantee or else I would keep your insurance in the loop as others have said.
Off topic, but anyone else think it's ironic that the OP is posting about getting rear ended when he has that name?

Thanks everyone for the replies.
Can anyone recommend a good body shop in Orange County, CA? I'll take it to the dealer also, but want to get a few quotes.
Thanks
