About to special order 2008 IS250, please review my gameplan!

I'm about to trade in my 07' IS250 for an 08' IS250 . Why not a base IS350? Gas prices, bit higher insurance, don't really "need" the power, daily driver and I'll appreciate the extra toys on long drives. Why not just keep the 07'? Too many to list, in the end I'm just not happy with this car (just my particular specimen).
Does my trade in and OTD price seem reasonable (too high, too low)?

Seems a bit high for a 250. Take away tax from your $38k OTD price and you're still about $2500 over invoice. Have you gotten quotes from at least two or three dealers? There are a lot of them in California, so it should be pretty competitive. Just make sure when they do your special order that they actually order it. It's a 3-4 month wait time, so you don't want a dealer that's going to mess around and not submit the order right away. Otherwise it'll be Valentines Day and not Christmas before you see this car.

Hrm. For lux and ML (Nav) on a 250 I would have been figuring 38k OTD as well and is what I would be shooting for come my purchase time. Maybe better deals can be had though!

I really hope you know what you are doing, and that you think this one won't have the same issues you had with the 07, or else you'll just be making the same mistake twice.
Are you going to make sure you check the paint and the interior gaps thoroughly this time? And are you still going to use the same dealer that you've had such a hard time with?
This time there's no more excuses, so I hope you're happy with the car at least for the next 6 months.
