Just a question here, if anyone know's about insurance, if someone hits you and totals your car and they are wrong, does their insurance have to pay you for what you owe on the car? example: my car cost 34 out the door, 3 months pass, car is totaled. would i get back 34 or near to it? sorry if it sounds stupid but i am curious to know or do i just get gap insurance to cover me?

If neither rear doors fit in the door openings anymore, then yes, its probably a total loss. At that point, you're basically rebuilding the entire unibody.

I'd like to point out, from all these threads about damage, that most cars don't have a "frame" these days. Its a unibody, where the outer sheet metal provides the strength and structure of the entire vehicle. Only trucks and truck-based SUVs still have "frames" beneath the cab and/or bed.

Thus, the point that usually determines a total loss is how much of the body must be rebuilt, repaired, or replaced. In this case, you're talking a major portion of the underbody, both sidemembers, and possibly the roof. That's at least 50-60% of the body.

Glad to hear you and your passengers are OK.

The at-fault party's auto insurance pays for the value of the car at the time of the accident. It really isn't reasonable to expect them to compensate you for loan payout. Think about it - if you really got slammed on your loan, or chose one of those lame "no payments until summer!!!" loans, it isn't the insurance company's fault.

That said, if you carry gap coverage on your policy, the difference between the car's value and your loan would be paid by your insurance company.

Thanks everyone.. I've been to the hospital, and I have a follow up appointment tomorrow.

I am hoping the cars totaled, Always wanted a white one, in a manual. Which they have in stock at this moment. 32k out the door.

From what I cold see under the car was in pretty bad shape. I will know more tomorrow.

Never owed on a car and been totaled. I just know to have gap on cars you finance to cover you just incase, thanks again for the info.

Glad to see you ok including after a 75mph impact. Now I would love to see one person in here say it is not totalled. Its gone start car shopping my friend and keep us posted.

Wow thats horrible. Here I am complaining that someone backed into my car and messed up my passenger doors, glad to hear you made it out alive.

I hate to see threads like this... but glad to see that you and your friends are in one piece. Car can be replaced, people can't be. Car looks in pretty bad shape, I agree with others and say that it's a goner. My advice, keep complaining about your back problems.
