07 IS250AWD 34k engine stumbling, won't go over 40mph. Second time this has occured.

my car is in the shop for same exact reasons... car in limp mode, vsc, CEL, traction control all lit up, engine shake... i have had the engine shake issues in the past. was told it was carbon build up. this was the first time the car went into limp mode and everything lit up. not too happy about this since the issue seems to be progressing into more serious conditions.

i wonder if cali's lemon law would apply to my case... my car (07 IS250, 46K miles) was bought in oct 2006, i have taken it in numerous times for the engine shaking issue and now this more serious one.

my wife's car just did this EXACT same thing today. RPMs shuddered (has happened in the past) but this time the stability system light came on and her car went into limp mode.
We had the dealer service the car before the warranty was up (50k) but looks like we'll need to go back.
Has anyone successfully gotten a dealer to honor the TSB posted earlier?
