Wow! The exact thing happen to me a couple of years ago. I tried to fight it but, it was my word against hers so, I ended up having to deal with the damage to my car. Unless you have a witness, you're pretty much screwed.

this happened to one of my friends before. she took pics of the accident the way it occured (neither her car nor the one who instigated the accident moved). it shows that the other party was clearly at fault based on which side (hood or trunk) had a concave shape from the accident. had the my friend from behind started the accident, her car wouldve produced a concave shape on the rear bumper of the car in front of her. in this case, because the driver ahead reversed, it caused a slight concave shape on her front bumper. sorry this happened to you. hopefully it gets resolved soon and in your favor, as it cleary shows that the guy in front of you is wrong.

Thanks everyone for your advice and support. He drove a 2008 Mercedes Benz ML320. I can't remember want condition it was in. I was kinda in shock what was going on. He was vietnamese. This guy Gives Vietnames people a bad name. I'm vietnames, I would never think about doing anything like this. If I ever hit someone I would take full responsebility. This guy has no integrity. I'll try to post pics up tomorrow.

its your world against his word... u need to prove that all the evidence are not true( not correct) or he can't proven you guilty from other party. this way you could fight off.. i think tire marks is a good sign !! he said you drive too fast.. there should have some tire marks from the car front of you!!
for exmple,
when the car front( car A) of you stopped for the red light , Car itself is in full break and complete stop.. let said you drive too fast and hit him from behind.. car A's should leave a tire marks b/c due to the force push by your car push him forward. in order word if you use a push an Erasers downward on the table, then you use a hand put forward... Erasers itself will left you a mark!!!

you're screwed without witnesses. all the insurance company has to work with is the fact that your front bumper hit his rear bumper, end of story, your fault.

that really sucks and i'm sorry, but that's the end of it, especially if you haven't told your insurance company already to investigate. if you report it now, they won't believe you. you might want to update us on whether or ot you talked to the insurance company.

I called my insurance as soon as i got home after the accident. They called this morning and said they were going to be doing an investigation. Hopefully it goes my way.

its gonna be an uphill battle for you buddy, in rear end cases, the person who got rear ended gets the favor so you really gotta fight up hill to get this one. that is terrible this happended to you.

i wouldnt have the ***** to do something like this because you never know how far that person will go to get revenge. i hope this gives you ideas =)
