250's outsell 350's so much more so because of their great publicized national/regional lease deals.
No way is the dealer going to take back a car with 200 miles on it for full value as it is now a used car, there is no way to get around that. So you will pay for the hefty depreciation that every car feels when it is driven off the lot. Perhaps he will work with you on the new IS350 price, but the value of the now used IS250 is baked into the cake of whatever deal you make. This would have been prevented if you had done more due diligence before you signed for the 250.

its a shame you couldnt realize this before purchasing the car. but nonetheless the 250 is a great car. give it some time, and you'll grow to like it even more. not sure what to do about increasing the power, as the 350 upgrade wouldve been the best bang for your buck. but i definitely wouldnt trade it back to the dealer. 200 miles, though small, will be considered used and the dealer will try to find a way to maximize their profits when trying to resell. just keep it, work on it, and grow to love it. best of luck!

Thanks for advice. I think that's what I i will do. It's a nice car no doubt.

What I didn't realize however is how much I would miss the extra power.

But you said you got an AWD 250. The price difference isn't 4-5 grand, it's $1500. (Between invoice on a 250 AWD and a 350)... and as you're finding the mileage isn't significantly different either because AWD kills gas mileage.

(even on RWD the 350 is 50% more power for only about 10% worse mileage)

It won't cost you anything to talk to the dealer and see what he's able to do. If it's unreasonable then don't do it. Longer you wait to ask the less likely he'll do anything for you though.

Like I said before my dealer will do this kind of exchange, not trade in. They will take the car back as if the deal never happened. I was told by the owner of the dealer himself. Its YMMV of course with dealer to dealer but it's worth asking. The longer you wait the harder it will to take yours back.

I'd stay away from that dealer. If he is taking it back at full value and then reselling it as a new car that is dishonest and unethical at best, and probably illegal at worst. Would you want to buy a car advertised as new only to find out it's been driven for awhile and then returned? I wouldn't. And no dealer is going to take car back at full value and then resell it at depreciated price, that is money coming directly out of his pocket.

I could be lacking some info, but don't you have 3 days to cancel a sales contract in most states?

Nope.

California, specifically, has the option of getting a 2 day return period for used cars only, and only if you elect that option when you buy it (and he can charge you both for the option, and a restocking fee if you exercise it). Most states have no such rules at all though.

I had almost the exact same thing happen to me. I ended up paying about $2000 for the loss in value on the returned new car, making it the most expensive rental I'd ever had, but it was the right decision for me, because I just was not happy driving the old car and I love driving the IS350.

In GA there is a 3-day "Buyers Remorse" clause. I believe he could take it back in GA. 150 makes it a "demo" car and they can sell it near face value. If anything I would expect some small fee. (by small i mean 1k or so)

FWIW the 350 is heads and tails above the 250 IMO. I've driven them both quite a bit and it's not even close. And the auto tranny is pretty awesome too, for an auto.

So what did they say, Sonnyk?

IS250 RWD, you do get a bit more power out of it since it does not have the extra components AWD requires.
