what became of it? was it covered under warranty or not?

How do you expect people to give you an educated answer (help) if you don't provide in detail what is going on. You leave a lot of variables open, even the letter seems like there is a lot missing. I don't understand why you would or could not post what the problem is, pretty sneaky if you ask me. There's your side, their side, and the truth.

I understand I am not opening up very much here, but the reason is not to destroy the relationship with Lexus. I still have 50,000 miles of warranty to go. The letter is complete. All I took out was their greeting and thank you sections.

All I am asking for is

1. Trust me. It is not my fault. The dealer is assuming it is my fault since they have not seen, according to them, anything like this.

2. I am not asking for your opinions on whether the defect is created by me or is genuinely a manufacturers defect. I am telling you it is a manufacturers defect.

3. Looking for a case where somebody has been denied warranty coverage and what recourse was taken. It may not be for the same reason that I am being denied. But it will set precedent and will help me understand why Lexus is behaving like this towards me.

I don't think with the limited information you're providing that anyone is going to provide you with remotely useful advise. I've never read of Lexus denying warranty service without some sort of defendable rationale. And seldom read about that, even with modified cars based on personal experience. All of that is dealer dependent at some level, of course.

Everybody (including me) is just going to keep guessing or asking for further info....

My guess is that this has something to do with Carbon Buildup in your IS250?

Honestly speaking, my experience with Lexus is not satisfying. Looks like they want to clamp down on Warranty expense and improve their bottom lines.

I have driven Mazdas for 11 years now and I think the next car will be a Mazda again. At least I will not be treated like this at my local Mazda dealership. No more Lexus for me. I should have stayed faithful to Mazda. Eleven years and the reliability was wonderful. Not a single problem that would not be covered under warranty and not a single problem that left me stranded by the roadside. What else to ask for? Technologically, the current Mazda lineup has all the gizmos that any lexus has, except the ventilated seats, and they are fun to drive..

Dave, I am not asking on any opinions on whether the defect my car has should be covered under warranty. Therefore I do not want to share that.

My quest is simple. Has anyone been denied warranty by Lexus without Lexus providing any reason for denial in written? If so, what is the recourse?

I spoke to Lexus corporate and asked them to give me a reason in writing on why the claim in being denied. The department specialist had the ***** to tell me he is not obligated to do so. But then he sends me the email and letter that I posted in the first post, which states very clearly that Lexus is denying coverage. No reason for denial is mentioned.

ya they just denied my warranty saying that it was mine fault...all warranty claims have to be approved by the tech manager, they have to give u a reason to deny your claim, in my case, they said it was my fault that it was damaged

from the Owner's Manual Supplement:

pp. 19-20:

WHAT IS NOT COVERED

This warranty does not cover damage or failures resulting directly or indirectly from any of the following:
* Fire, accidents or theft
* Abuse or negligence
* Misuse - for example, racing or overloading
* Improper repairs
* Alteration or tampering, including installation of non-Genuine Lexus Accessories
* Lack of or improper maintenance, including use of fluids than those specified in the Owner's Manual
* Installation of non-Genuine Lexus Parts
* Airborne chemicals, tree sap, road debris (including stone chips), rail dust, salt, hail, floods, wind storms, lightning and other environmental conditions
* Water contamination
there's another page of information of what's not covered under the warranty:
- tires
- normal wear and tear
- maintenance expense
- vehicles with altered odometer
- vehicles with unknown VIN
- salvage or total-loss vehicles
- incidental damages

on page 21 there is also a dispute resolution, which refers you to pp. 9-10. check step 3 (pp. 10-13) for your last probable solution to dispute resolution.

of course, it is up to the discretion of your local authorized lexus dealer and/or lexus of america to determine whether or not your claim is covered by your warranty. in addition, unless there is a law that specifically states that warranty claim denials must be disclosed (which may or may not exist for each state), so as such the department specialist was not legally obligated to disclose the reason for warranty claim denial.

with all due respect, i'm spelling this out because i believe the community wants to help or at least see what happens. however, without additional disclosure of material facts relating to your warranty claim denial - at least coming from you, a lot of what we are able to do (and have been doing) is speculate.

And how did they prove it is your fault? Was it obvious or was it only their opinion?

Agree with Optik..............if you feel strongly manufature defect and have proof then let the lawyer do the talking. Best of everyhting and keep us update.
