So you drove in a reckless manner, and it is the other guys fault? Are you a Democrat by chance?
You may want to look up the Motor Vehicle Code, there is a law called the "Assured Clear Distance Rule" In essence it says you can only drive as fast as the assured clear distance ahead of you dictates. What you did is NO different than the guy whom text while driving you took you eyes off the road in front of you while you were moving forward.... BANG... YOUR FAULT

Sucks about getting rear-ended. Coming to a stop at the bottom of an off-ramp that ends shouldn't be too hard to do, but some people have other ideas. Hopefully your insurance company can sort it out. At least you were okay, the other guy stopped, and had insurance. I got broad-sided in 2008 and my back is still giving me problems. For what it's worth, I could not get the LAPD to come out to my scene, with three cars involved and one being totalled. As long as no one was hurt, they don't come.
