I had the same issue but not with my OEM bulbs. I purchased a pair of 8000K Garax bulbs and the issue appeared 6-7 months after installation. I ordered a pair of Phillips bulbs hoping it fixes the issue. Hope its not the ballast.

I got the new one replaced today, the issue stopped. I'm not sure the exact bult they put in, but when I step away from the car about 30-40 feet the new one on the right is insanely brighter then the other.
The one they pulled out that was faulty was the Philips 42402
I think I am going to put in 2 new Philips 85122+ which are 4300k is there any issues with using 2 of these bulbs new?

The right one meaning...the passenger side? Your passenger side headlight will appear brighter because it should be aimed higher than the driver side. The driver's side is supposed to be lower to prevent blinding other drivers. Did they only replace one bulb? or both?

my friend runs a hid retro fitting business and can offer me some Philips 85122+ 4300k for $90 tomorrow, but I think I might order these

can anyone verify if this seller is legit and these are in fact the ones that I am able to replace with? just dont want to short out my ballast or create any problems D4S Garax 6000k look nice.

I don't think the 85122+ come in D4s size, correct me if I'm wrong please. Skip eBay on those Garax...get them from our vendors. They should be about the same price, if not cheaper than that eBay link, and you wouldn't run the risk of grabbing a knockoff or bad set from eBay or something.
If you're just looking at replacing the bulbs, then any D4S bulb would be a direct replacement..no other modifications necessary. The ballast shouldn't really go bad because of a bad bulb.
