I was rear ended, after about five months of having my '07 IS250...just under 18k in damages, I filed through my insurance first, and let them go after the other insurance company for the money. Worked like a charm! Hoping that I would never have to do that again...but if I do I would do it the same way.

sorry to see that! Mines was rearended the first week! by a uninsured driver that gave me a bogus insurance.. I ate the damage myself... people without insurance shouldn't be on the road .
and the guy was driving a C350!

I hate it when offending drivers attempt to play the "there isn't that much damage" card - its a personal pet peeve of mine.
OTOH when police refuse to come to the scene of an accident, pictures (not just of your car, but of the other vehicle, location, etc.) and/or a video always help with insurance settlements.
