You remind me of the accident I got into recently. I got hit at almost 40 MPH where my frame is bent, car got knocked into another direction, and bumper flew off many feet away. I got out with just some knee pain while the other lady calls an ambulance and gets taken away in a stretcher when her car just has a cracked headlight with a dented bumper and fender. There is no way she could have suffered that much and she was exaggerating to make things seem worse on my part. Still have to go to court about the accident next week...

Damn reading some of your stories, seems like there are a lot of shady people out there! Gotta be extra careful nowadays i guess.. lol
I'm not worried about the claim though, i know my insurance will take care of it, and given all the information i've sent to them, i'm pretty sure she her case would get shot down quickly if she tried to claim payment for injuries.

Let your insurance handle it...that's what you pay them for. But...if you happen to see her out disco dancing...snap a picture.

Overall I think you'll be good. The CHP seems like one source to confirm no damage to either vehicle which I think would cancel out her claim of feeling neck pain, especially since she also denied an ambulance. Anyone in serious pain would get one. Fraud is a big deal and her insurance company may even talk her out of this phony claim of neck injury.. what a dumb breeze. Sorry to hear your getting some actual effects from the accident... a headache from her phony baloney claim.

I had that happen to me. Bumped someone when I was going 5km in my GSR. He got out and everything was fine, he even said he was fine. A few days later the insurance company calls and said the dude was filing for injury. There was no damage on either car. The insurance company called it a "low velocity impact". No damage, no settlement.

Glad the CHP is on your side. Also if she has a history of this type of stuff it will not help her case either. I have had some minor fender benders, but glad no one pulled this one me. Sadly, if insurance companies have to work to win a frivolous law suits, l could mean higher premiums for all of us in the long run.

Similar fraud like thing.
Over heard from some else - happened at a parking lot. The person was backing out of the parking out very slowly and somehow he "touch" an oncoming car.
OK so they get the incident reported and here is the catch - the oncoming car was in a bad condition so the person backing out reported to the insurance that there is a suspicion that the oncoming car intentionally touched him to get something from it as it appeared not to stop since there was more than enough time for him to notice his car was backing out.

Yeah i just don't see how a 2-3mph impact that didn't leave a scratch on my car (i tripled checked, cant find a scratch anywhere) would cause injury to another person. Everyone that has seen my car since yesterday cannot find where any damage was done either.
Even the CHP officer said that he would be a little worried for her if such a small incident caused injury.

Update:
I gave my insurance company a call since they really haven't said much since the accident. Turns out, they paid her an undisclosed amount for her bumper. I told them there was really no damage, maybe a clip popped out at most, but they are paying her for the bumper anyways i guess.
She also did go ahead and file an injury claim. Absolutely absurd for what this accident really was. But it looks like she is getting away with it. I'm speaking to the injury claim specialist tomorrow. She went to the ER after the accident apparently....even though CHP officers offered her one on scene and she repeatedly rejected it. But from my understanding, seems like there's also a high chance they are going to be issuing her a settlement money for her "injury".
I also believe my insurance company hasn't even seen the police report yet. It's been only 5 business days since the accident, police report's are usually available after 10. I'll find out tomorrow if they have even seen it yet or not, but if they haven't, ill be asking why they are using claim money without it.
I will be losing my good driver discount (20%), I'll have an accident + bodily injury on my record (+xx%) as well now because of this. I was looking to get a GS400 on the side, but now i'll probably have to scrap that idea and just keep the IS or sell it and get just a GS400.
Be careful out there guys! All you need is one accident with the wrong person and they can really screw things up for you.

Ouch. Something like this happened in my old car when I was younger. Was looking at my cell phone at a red light then I accidentally let go of my brakes by accident then BOOM. Luckily, the old man did not really care..
