Looks like you we're sold a used product. I would be extremely pissed if I paid for a brand new item and received a used item.
You probably can't get just compensation for the damage to the exhaust. If the scratches are minor maybe you can buff it out with some work. I know it's terrible that you have to put in some extra work to make the exhaust "like new"
If the damage is more than a few scratches then I would request $50-$150 in compensation like others have already stated. Good luck OP.

If it is a dealership, I would email them the pictures and explain to them it was bought NEW and supposed to be new and appears used. Ask them to do the right thing and refund what they feel should be a fair price for a USED exhaust. I'm sure they will work with you.
