For the simple fact that the yellow car was crossing a solid white line he/she is at fault, that and the position the car is in even makes it seem as if it was traveling halfway in the wrong direction (diagonally towards you).
So in my opinion there is no question the yellow car is at fault, and so were the idiots that stopped and gave way for this to happen in the first place. I often block on purpose because I do not want to cause an accident like this (if I'm in the travel lane and someone is trying to do what the yellow car did).
Sorry about the damage but glad nobody else was hurt.

Thanks for the responses everyone! Dealing with this insurance is such a hassel! I talked to the body shop and im probably going to throw some extra money to get the fsport bumper. does anyone know if it is a direct fit without having to do any modding?

how does that happen?!?! i talked to the body shop and they said they have to make it stock how it was. he said he could cut me a check for the price of the bumper and i would have to get the fsport myself and pay the difference and bring it to them and they would paint and install.

From an insurance and legal standpoint, the yellow car is at fault.
From a practical standpoint, you are at fault. A good. defense driver is always aware of situations like this. In fact this is a classic and extremely common situation that you should've been aware of.
Every time I'm in the left lane (in your position) and I see a long line of cars in the right lane and an opening (like the one to the gas station), I always slow down (sometimes to a crawl) to accommodate cars like the yellow car in this example.

i told the body shop to look into that bc it was a direct swap (no mods needed) they didnt believe me so they called the dealership where they get the parts from and the stupid lady told them it doesnt fit. Which is wrong. So by the time I got through to them that the bumper fit they had already received the original bumper. I was frustrated so i just let it go.
