brake pad caliper bolt is sticking out!
2008 Lexus IS250
there are two little bolts that seem to slide in and hold the brake pads in place
one of them is sticking out
I mean, sticking so far out it is like almost going to be chopped off by the wheel spokes
Ive never seen this happen before, it is a common problem?

Rear brakes, right? Clip either fell off, was never installed during a pad change, or rusted off. It looks like the clip is there though, so it may have backed out of the slide pin. You'll have to take the wheel off and inspect it.

I took the pin out and it definitely looks like one side is shorter
and it was very easy to take and wiggled
edit: one last question
so how do I know if I have the sport suspension package
apparently, there are two different part numbers for this pin set...
I know I have the 18" wheel package RWD
these should be included with a new set of aftermarket brake pads like from autozone?

glad you found it before it slipped further and contacted the wheel!
the retaining clip looks healthy, just need to be installed properly.
it should not just come off easily (especially if you were able to do so with the wheel on!).
it needs to be compressed (slightly bent) to get out, and having one side longer is normal.
first is to remove the wheel and push back the pins into the caliper.
slip the long end of the retaining clip through the upper pin (there is a hole on the side, sometimes requiring you to rotate the pin) and then insert other end through the other pin.
then you should rotate the retaining clip down and lightly compress it though the "hole", like the second picture, locking it in place.
you should be able to do this with your fingers!

Looks like the retaining clip either wasn't installed correctly or somehow slipped out. Just reuse the retaining clip, it looks fine. I had to buy a new set of pins and clips for like $40 because I lost a retaining clip. While you're at it, you might as well service the brakes since the IS250 rear brakes are prone to seizing

it certainly does not look healthy to me, for a start one end is a lot shorter than the other from the last bend in the wire, I guess it was this 'short' end that was supposed to be in the pad retaining pin that tried to escape.
the clips in the link posted above in #2 do not look the same as these clips as they have different type ends!

on my LS400 I recall it was not quite symmetrical, perhaps mine was broken too. different car, not applicable.
