Thumbs down Hey Guys I'm Back!!! Accident #2 w/ 2015 3IS 250 F-Sport :(

Last night I was driving on the 101 freeway, near downtown in lane number 3 (of 4, second to right) and this Toyota Corolla in front of me signaled to turn into the #4 lane (far right of the freeway)

He signaled for about 8 seconds then canceled his signal and continued driving in lane #3 (original lane, as I was driving behind him)

Soon after his lane signal cancellation I proceed to signal to turn into lane #4 (far right) and pass him.

As I am about to reach his passenger door from the front of my car, be proceeds to turn into me!!



Keep in mind, there is no shoulder past lane #4 on the 101 Northbound towards Downtown LA. It's a huge white curb!

I became pinned to the curb and his vehicle. It was the scariest situation ever and could have resulted much worse.

OUCH OUCH OUCH!!

That is so painful to look at ... I hope you will be able to get it repaired without any problems but it sure takes the fun of owning after seeing it like that.

did police come and put the corolla at fault? Being that you were pinned between the curb and car, it was the corolla moving into you

Oh, boy! It's so frustrating and irritating to go through the an accident once more Glad that you made it out safe and hopefully car gets fixed soon!

Ouch sorry to hear. LA has the worst drivers.

Police did not come since there was no injury, but I called my lawyer immediately after leaving the scene.

Good luck with that.

Other driver will say he was clear to the lane, signaled, and you passed on the right at a high rate of speed.

That'll be the end of that, since the physical evidence supports it and both versions of the story (his and yours) have you passing on the right.

Hopefully your lawyer is straight up and told you that you're only fighting over the deductible, and it will cost you more than that for his services even if you prevail.

Actually, he might be in the right. It's called lane violation and if the other driver hit him by going into his lane, it's the other drivers fault of whether he signaled or not. I know this cause I was in a similar accident where I signaled and the other driver went right and I went right. I hit him even though he made a similar high speed pass on the right and I was deemed at fault.

To the OP, go fight. I say you have a good chance.

Yeah!! Thanks everyone for your support, means a lot.

My lawyer has taken over and it's going to be taken care of. It's the other vehicles fault, turning into my lane, whether I was passing him from behind, to come around his right or not.

He pinned me into lane #4 which curbed my rims to the right curb, since there was no shoulder, otherwise I would have avoided the accident.

Going to get some back massages out of this.
