True the claimant has no contractual agreement but if they opted to go with the other party's insurance to handle the claim and the company does not pay for diminished value, they're SOL. Just because they demand it doesn't mean it will be given. It's as simple as that.

What that article is telling you if the other carrier doesn't assist with diminution of value the claimant party has a right to sue the other party for that loss.

Just FYI, claims is my daily grind for a major insurance carrier here in CA.
