insurance is only responsible for paying diminished value claims if you are NOT at fault - if you ran into someone else consider the 8K loss in value a hard lesson learned...

I got double screwed. They guy hit me and took off. They still haven't found who did it.

Most insurance contracts do not pay diminished value, meaning your own insurance will not pay you. However if you are dealing with the at-fault's insurance company (the other party) you can pursue diminished value. You probably want to involve a lawyer as the insurance companies will pretty much ignore you until you start to sue.

Do every thing and get a new car. That what I would do nothing to regret. It's a positive for a new better car

Yes, it hurts to see this, but there is no way an insurance company will total a car with that little damage.

That's pretty hard to look at. Hopefully the process won't take too long to repair. Once you get the car back, give it a hard look all around and make sure there is nothing misaligned. I've had a few friends who were so anxious to get their cars back after getting fixed that soon after realized the cars aren't driving straight anymore. Best of luck with the repairs!

I got a hit and run on my IS300 last month it was no fun.
