Did you buy 2013 used ISF from dealer in Monterey?

If you signed an AS IS sales contract then most likely you are SOL. Nothing you can really do and from what you described it sounds like they did not break any state or federal laws in regards to selling used cars. Your first stop is probably your states consumer protection office to see what they say.

He'll have to show that the dealer omitted or misrepresented material facts, resulting in a financial loss. He'll definitely have an uphill battle dealing with these slimy dealerships that will lie at all costs. A dealership crashed my dads car right after he bought it and they denied it was their fault and that they weren't responsible. It was a nightmare getting them to make their wrong a right.

+1, in full agreement here.
They either need to fix their mistake, or face legal action. Give them a nice review on Angie's List and Yelp.
You can also tell them, you belong to a car forum with an ARMY of ISF's, and that they may choose not to set foot in that dealership and will spread the word around.
I have a gut feeling someone at that dealership is about to get fired.

Ummm perhaps. Taking this to court is going up against deep pockets. I've got the goods on them though. There are a handful of things dealers are supposed to disclose if they have knowledge. This certain thing they surely have knowledge. Just slimy though. I expect a little better from a big dealer backed by a company like Lexus.

Is it fair to say if you went to look at a car like this and last minute seller says "oh hey this car was used at a performance driving school" you'd be uh no thanks? Especially at that price.

Just thought about this:
1. Did you consider contacting the OWNER of the Dealership?
2. How about Corporate Lexus?

Waht was the app that you downloaded to check its history? Also, doesnt the service history only show you the dealership related service and not who the car was owned or leased by?

very simple. I would sue the dealer for lieing or make it right by buying you out of the car less the usage.
Also you should contact lexus of america and explain what happened, and that you are extremely dissatisfied.

It clearly shows when the car was new it was prepped and delivered to the racing school. Part of the bill was a charge for the annual registration. That was not shared with car fax and was not disclosed when I bought it. I even asked if it was there.

I'm exploring punitive damages. Just on principle. It's been determined that I have a good case but still researching the viability of going after more than selling the car back.

My Lexus app from the App Store.

How much did you pay for the car?
What is the car worth now?
Next is the thinking stage.......is the car running ok? Is there something mechanical wrong with it? The question becomes, is it worth the legal fight or should you cut your "loss" and keep it. Depending on the market value, maybe sell it?
