It sucks even more than it was your friend that got hit and not the guy that ran the light I wouldn't want to claim something against my friend like that. Especially since I'm assuming her car was smaller/lighter and therefore stopped faster as well.

Accident is an accident. The other parties insurance pays, not your own. But if your insurance is involved in the claim, yeah they can drop you for being a liability -- People are 'accident prone' heh.. so your stuck atm of course.

As for the friend, and not claiming. It isn't anything personal, it is what insurance is for. You could be extra nice and let the friend pay for repairs out of pocket if he doesn't want a claim, but friend or not I wouldn't just say no big deal man.. I'll pay the couple thousand this is gonna cost, wouldn't want to hurt your insurance record -- Same goes with family.

*The above is hypothetical and doesn't have to do with this accident. -- IE: If you rearended someone who slammed on their brakes it isn't easy to get it proven NOT your fault anyhow. Hence the fraud 'squatters' around.

To each his own though.

we thought about her claiming it as her fault but.. you know...

her insurance company is not going to go "oh? you said this accident was your fault? okay, sure, we'll fix both cars!"

they are going to spin this in a way that ends up with me at fault and me paying them for her damages or me paying my insurance deductible, them paying for her damages, then me getting dropped from my insurance.

i'm just fixing it myself and she'll probably help me out with $ to get the thing painted... as for her repairs......yeah i'll just stop there, lol
