Driverside glass clamp broke off...

Driverside glass clamp broke off...
I have a 98 LX470 with the extended Certified Used Warranty........ a couple of days ago, I started to roll my driverside window down, and the front end of the window just tilted down like it fell off its alignment. Any attempt to either roll the window up/down may break the glass. I immediately took it in the dealer for a look...
Just got an update and the dealer said that the glass clamp had indeed broken off and that they've seen this occur in the early production of LX's... to repair, the consultant said that the warranty will only cover for the window modulator (?I think that's what the tech called it?), but I would have to pay for the new glass and the labor (~$400)!
I felt that the warranty should cover the complete cost partly because its a known issue with Lexus and that it's not wear n' tear. So I;m having the consultant double-checking with the general mgr. But have anyone heard of this issue? And do you think its fair that I have to put out any money? Thx in advance.
