Default Ticket for DWT (Driving While Talking)

Just a heads up to everyone up here...A friend of the family just got a ticket for talking on the phone w/o a headset...$250. If in a construction zone, the fine goes up to $1,000 (according to them). Happened in Santa Clara.

I heard that there was a new rule about this, but didn't know that it was being enforced already.

That headset law goes into effect in 2008. If your friend was cited for talking on a handset, I'd challenge the ticket.

As said in previous replies, the law is not even effective yet. Not sure why a police will do such things? (Santa Clara, California?) First time I've heard this.

To all who posted...yeah, I was under the same impression you guys are and told them to fight the ticket...BUT

then my wife (she does loans and title companies usually send out e-mails about noteworthy news items to their clients) showed me an e-mail she got from a title company here in Santa Clara (CA) regarding new laws...AND one of them was exactly what my friend got ticketed for

the e-mail said it was a $250 fine for talking w/o headset while driving and a $1,000 fine if doing this in a construction zone. Weird thing is, the e-mail also stated it wasn't going to be effective until July 1, 2007, so I told them to fight it anyways.

DRIVING FINES FOR 2007
1. Carpool Lane- 1st time $1068.50 starting 7/1/07 (The $271 posted on the highway is old). 2nd time is going to be double. 3rd time triple, and 4th time license suspended.

2. Incorrect lane change -$380. Don’t cross the lane on solid lines or intersections

3. Block intersection - $485

4. Driving on the shoulder- $450

5. Cell phone use in the construction zone. - Double fine as of 7/1/07

6. Passengers over 18 not their seat-belts- both passengers and drivers get tickets.

7. Speeders can only drive 3 miles above the limit.

8. DUI=JAIL (Stays on your driving record for 10 years!)

9. As of 7/1/07 cell phone use must be “hands free” while driving. Ticket is $285.

My friend just send me some information on this. That she has been seeing false emails or posting about the laws. And that this cell phone use does not take affect til next next year.

Fact: There is currently no law against using a cell phone while driving. The law passed recently by the register requiring the use of hands-free headsets does not take effect until July 1, 2008. Otherwise, fines for traffic violations committed in constructions zones are higher than those committed elsewhere, but not quite double.

yeah, dunno wats going on...but just found information on the hoax e-mail, but still doesn't explain how the cop can give my friend a ticket for something that doesn't take effect until next year....already told them to fight the ticket

I checked the DMV's New laws for 07' and it is effective July 1st, 2008. Weird. I could have sworn I saw that it was effective July 1st of this year the last time I checked it. I guess it's better to get into the habit of using a handsfree set anyways. I just purchased a Motorola H700 Bluetooth headset a few weeks ago. It was around $25.

This is quite a dispute over this cell phone law. ha. Well everybody keeps saying it is a hoax and that the law doesnt start until 08.

It's the only thing i could find so far....
The cell phone headset law is one of the only grains of truth inside this (along with the seatbelt one), and my guess is that because people had heard something about that headset law, this hoax was successful in fooling people about this whole ridiculous list. But even the cell phone one is way off -- beyond the date being a year wrong, the amounts are totally wrong (it is actually $20 first offense).
